Delivery and phrases

§ 1. DEFINITIONS

1. Consumer – a natural person performing a legal act not directly related to his or her business or professional activity;

2. Entrepreneur Consumer – a natural person conducting business activity based on an entry in the Central Registration and Information on Business (including a partner in a civil partnership), concluding a contract directly related to his/her business activity, when the content of this contract indicates that it is not of a professional nature for this person, resulting in particular from the subject of the business activity performed by him/her, made available on the basis of the provisions on the Central Registration and Information on Business.

§ 2. WITHDRAWAL FROM THE SALES CONTRACT

1. 1. The Seller informs that pursuant to Article 27 of the Act of 30 May 2014 on consumer rights, the Buyer who is a Consumer or an Entrepreneur-Consumer may withdraw from the sales agreement concluded with the Seller, except for the cases indicated in Article 38 of the Act of 30 May 2014 on consumer rights (withdrawal is not possible, among other things, when the purchased item serves to meet the individual needs of the Buyer being a Consumer or an Entrepreneur-Consumer). 

2. 2. Withdrawal from the sales contract does not require giving reasons, and the Buyer who is a Consumer or an Entrepreneur-Consumer does not bear any costs related thereto, except for the direct costs of returning the goods to the Seller. 

2. 3. If the Buyer who is a Consumer or an Entrepreneur-Consumer has the right to withdraw from the sales contract, it is sufficient to inform the Seller of their decision within 14 days by sending an e-mail to the following address: waw@centrumkas.pl. The Buyer who is a Consumer or an Entrepreneur-Consumer may also use the template declaration of withdrawal from the sales contract available at - here.  The period for withdrawal from the sales contract begins when the Buyer who is a Consumer or an Entrepreneur-Consumer or a third party indicated by such Buyer other than the carrier takes possession of the goods, and in the case of a sales contract which: 

1. 1. 1. covers many things that are delivered separately, in batches or in parts - from the taking of possession of the last thing, batch or part thereof, 
      2. consists in the regular delivery of goods for a specified period of time - from the moment of taking possession of the first item.

To meet the above deadline, it is sufficient to send the declaration before its expiry.

2. 4. All payments made by the Buyer who is a Consumer or an Entrepreneur-Consumer (including the costs of delivering the goods) will be returned to the Buyer who is a Consumer or an Entrepreneur-Consumer immediately, but no later than within 14 calendar days from the date of receipt by the Seller of the declaration of withdrawal from the sales contract by the Buyer who is a Consumer or an Entrepreneur-Consumer.

2. 5. The Seller shall refund the payment using the same method of payment as used by the Buyer who is a Consumer or an Entrepreneur-Consumer, unless the Buyer who is a Consumer or an Entrepreneur-Consumer has expressly agreed to a different method of refund that does not involve any costs for him.

2. 6. The Seller may withhold the reimbursement of payments received from the Buyer who is a Consumer or an Entrepreneur-Consumer until he receives the goods back or the Buyer who is a Consumer or an Entrepreneur-Consumer provides proof of sending them back, depending on which event occurs first - unless the Seller has offered to collect the goods himself.

2. 7. A Buyer who is a Consumer or Entrepreneur-Consumer is obligated to return the item to the Seller or hand it over to a person authorized by the Seller to collect it immediately, but no later than 14 days from the date on which they withdrew from the sales contract, unless the Seller has offered to collect the item themselves. To meet the aforementioned deadline, it is sufficient to return the item before the deadline expires.
